Matthew Mazur, P.A. provides Personal Counsel Services to individuals, professionals, small businesses, corporations, hospitals, etc. When you retain our firm to provide you with Personal Counsel Services, we perform the following functions, including but not limited to:
1. We contact the insurance company and the attorney appointed by the insurance company to advise them that we have been retained as your Personal Counsel. We ask that all future correspondence, pleadings, notices, etc. be provided to our firm so that we can properly monitor the case on behalf of our client. We also request copies of all correspondence, pleadings, discovery, etc. that has been done prior to our retention as Personal Counsel.
2. We contact the plaintiff's counsel and advise them that we have been retained as personal counsel and request all future correspondence, pleadings, discovery, etc. be provided to our firm so that we can properly monitor the case on behalf of our client.
3. We review the entire case and provide our evaluation to our client based upon our review of the case file from their insurance defense attorney, our discussions with the insurance company and plaintiff's counsel.
4. We will attend the depositions of our client, significant witnesses, plaintiff's and experts agreed upon by our client.
5. We will attend mediation and trial, as agreed upon with our client, to ensure their rights and interests are being protected.
6. We will write the necessary letters and make the necessary phone calls to protect our client's rights and interests as they relate to the handling of their case by the insurance company and their appointed attorney.
For professionals, such as physicians, nurses, accountants, dentists, etc., Personal Counsel Services are important to ensure that their professional licenses are protected.
For physicians in Florida, it is important to remember that there is now a Three Strike Rule in effect and an adverse result at trial could result in the loss of a physician's license to practice medicine. Unfortunately, sometimes the interests of an insured physician are at odds with their insurance company. It is situations such as this, that necessitate Personal Counsel to protect the physician's interests.
Matthew Mazur, P.A. is available to represent physicians who, are not currently insured ("bare") on a case by case basis. Not having insurance does not prevent you from being sued. If you ignore a claim against you, there are significant risks involved with that decision.

Unfortunately, sometimes the attorney appointed by the insurance company is put in a compromising position between the interests of their client and the interests of the insurance company. It is these situations that necessitate the retention of Personal Counsel to protect the rights and interests of the insured client, which the appointed defense counsel is unable to do.
Personal Counsel can write the necessary letters and make the necessary phone calls to ensure that the insured client's claim is being handled in "good faith." If it is not, the Personal Counsel can pursue "Bad Faith" claims on behalf of the insured client that the appointed insurance defense attorney cannot.
If "Bad Faith" in the handling of an insured client's case occurs and there is an excess verdict above the insured client's policy limits, Personal Counsel can often times negotiate with the plaintiff's counsel to assign the insured client's rights under "Bad Faith" to the plaintiff.
With regard to Physicians, given the current climate in Florida and the Three Strike Rule, the stakes are too high to chance an adverse result.
